MONELL v. DEPARTMENT OF SOCIAL SERVICES 436 U.S. 658 (1978)In 1961, MONROE V. PAPE had held municipalities effectively immune from suit under SECTION 1983, TITLE 42, UNITED STATES CODE. Monell reinterpreted the legislative history relied upon in Monroe to conclude that municipalities may be sued under section 1983 but are liable only for acts constituting official policy.
