QUERN v. JORDAN 440 U.S. 332 (1979)This case held that SECTION 1983, TITLE 42, UNITED STATES CODE, does not abrogate the states' ELEVENTH AMENDMENT immunity from suit in federal court. The amendment therefore precludes retroactive damage awards against states. States, however, may be forced to bear the costs of future compliance with the Constitution and state officials may be enjoined to comply with the Constitution. THEODORE EISENBERG |
