ZEMEL v. RUSK 381 U.S. 1 (1965)In Zemel the Supreme Court sustained (6–3) the constitutionality of the secretary of state's refusal to validate passports for travel to Cuba. Chief Justice EARL WARREN, for the majority, rejected two arguments for the petitioner: that he had a RIGHT TO TRAVEL under the DUE PROCESS clause of the Fifth Amendment; and that he had a FIRST AMENDMENT right to travel to Cuba to gather information.
